What matters should be taken into account when licensed estate agents are dealing with sale/purchase and leasing of flats under the Home Ownership Scheme (HOS), the Private Sector Participation Scheme (PSPS) and the Tenants Purchase Scheme (TPS) of the Hong Kong Housing Authority?

  Under the Housing Ordiance (Cap 283), flats under HOS, PSPS and TPS are subject to alienation restriction. Before the alienation restriction is removed, such flats may not be resold, leased or re-mortgaged.

In both sale & purchase and leasing situations, licensed estate agents should clarify the following issues to their clients:
   
  (1) whether the estate concerned is subject to alienation restriction;
  (2) whether the alienation restriction of the flat has been removed; or
  (3) whether arrangement has been made for its removal.
   
  To clarify the above issues, licensed estate agents may obtain a latest copy of land search from the Land Registry for client's information. In addition, estate practitioners may refer to the website of Housing Authority for the updated lists of estates subject to alienation restrictions.
