What kind of matters should a landlord be aware of before appointing an agent?

  A landlord should appoint only licensed estate agents or salespersons to handle the sale or leasing of a property and provide the agent with the relevant information of the property for sale or leasing . Besides, the landlord should allow the purchaser or the tenant to inspect the property and specify all the items to be included in the property for sale or leasing (eg. furniture and fixtures). Final inspection of the property should be made by the purchaser or the tenant before completion of the transaction. The landlord should also give clear and proper instructions to the agent and ask the agent for copies of all the document signed. In addition, the landlord should sign an Estate Agency Agreement with the agent to safeguard the interests of both parties and take special note of the following items in the agreement:

  (a) Amount or ratio of commission and time of payment.
(b) Whether an agent is a "non-exclusive agent" or "exclusive agent" and in case of the latter, the agent has a right to claim commission if the vendor or the landlord enters into a binding agreement for sale or leasing through another agent within the validity period of the agreement.
  (c) Whether it is a "single agency" or "dual agency" or "potentially dual agency" and in the latter two cases, Agent needs to inform you of the dual agency and disclose the amount of commission he/she charges the other party.
  (d) In the case of sale, fill out the Vendor's Statement which includes the disclosure of whether there have been any structural additions or alterations to the property and request for repairs together with the cost involved.
